It's not completely my art because its a coloring contest, but the lineart was free to competitors, and someone remixed MY entry and claimed it as theirs. @cutejuicy (who admitted herself that she was a bad speller so i am going to correct her spelling) said, "ok i made a remix of this one but don't worry i will tell people that is not mine jock of cores is mine" (ok I made a remix of this one but don't worry I will tell people that it is not mine. Joke! Of course it's mine). I know how to "translate" the writing and know what she meant because in the comments she said, "i like this and is mine," meaning that she did not give credit, therefore stealing my work and just changing the color. My replies to her art theft were: -"please delete this project for copying mine and just changing the colors otherwise i will report this project" -*no reply/no deletion* -"sorry im not trying to be mean its just that this is art theft" -*no reply/no deletion* -"can you delete it now" -*no reply/no deletion* -"IT IS NOT YOURS ITS MINE THIS IS ART THEFT AND IT IS ILLEGAL." -*no reply/no deletion* - "if this is not gone in the next day i will report it. you did not give credit or ask if you could use it so it is art theft." -*no reply/no deletion* -"i'm getting impatient now." -*no reply/no deletion* -"Scratch Community Guidline #3 states that 'You are free to remix projects, ideas, images, or anything else you find on Scratch – and anyone can use anything that you share. Be sure to give credit when you remix.' BE SURE TO GIVE CREDIT WHEN YOU REMIX. I am getting very impatient and I will not wait to report this." I understand that some people may think, "why is scratchdoodlegirl being so impatient?!" Well, I'm not being impatient. Reasons: -Art theft is illegal, therefore it cannot wait. -Her remix was only a few minutes before I realized she had remixed/stolen my art. After reporting the project, Ligtnin* thought I was mistaken. Here was our conversation: -"I'm afraid you are mistaken - this is clearly changed from your original (which is itself a remix.) You may ask them, respectfully, to give you credit in the notes. But it already clearly says it's based on yours." -" I understand that it is changed, but cutejuicy has stated, twice, that it is his/hers without giving any credit. On Wiki Answers, the answer to the question "Why is art theft illegal?" states that "Unauthorized use or redistribution of artwork, as well as copying, tracing, altering, or heavily referencing without permission is considered art theft...Do not assume that little changes will make it all yours and that you will not be held responsible." I'm sorry to argue, but all he/she changed was the color of the cat with the fill tool. The background, text, and design on the cat are the same. Without Scratch's "Based on" feature, the art would give no credit at all. At first, I did ask respectfully, but then I got impatient (which I am sorry for) and decided to report the project right away. Mine was a remix to the coloring contest, and it did not ask to give credit. Mine did not ask either, but you are supposed to remix a coloring contest. The coloring contest also forbids copying ideas and art, and though the contest is now closed, this would be breaking the rules of the coloring contest, and for not giving credit, it would be breaking the Scratch Community Guidelines." -"So with Scratch the rule is this: If you don't want it remixed, don't share it. Sorry, it's as simple as that. We will ask them to be sure to give credit, but you need to give them time (they may not come back on for a while.)" If I wanted to argue more and fight for my "cause/case," I would state the following (though I did not because (1) he did not look like he was going to change his mind soon (or ever) (2) I had already used some of the evidence in my comments (but do read all of them, even if they are repeated, because they all connect)): Lightnin* said if you don't want it remixed, don't share it. Yet - I've seen many projects that say "DO NOT REMIX." Of course, mine did not say that, but I never said anyone COULD remix it... So maybe Lightnin* should go talk to the creators of those projects... On the Scratch Wiki, the answer to the question "What do I do about someone who is copying my projects?" is "Scratch supports remixing, taking a project and modifying it. If someone copies your project exactly, it is OK to flag it, making sure to mention that it is an exact copy." The project the person remixed was not an exact copy, so, according to the Wiki, it is okay. YET IT CONTAINED ART WHICH WAS MODIFIED WITHOUT PERMISSION; THEREFORE, IT WAS ART THEFT, MAKING IT ILLEGAL. While you may not be able to sue people over usage (depending on if it was commercial use or not) you are still entitled to your work, and have some legal protection. Scratch Community Guidline #3 states that "You are free to remix projects, ideas, images, or anything else you find on Scratch – and anyone can use anything that you share. Be sure to give credit when you remix.'" BE SURE TO GIVE CREDIT WHEN YOU REMIX. Sign it NOW even if you think it is no big deal. You will regret it later when someone steals your art or your music or your project and claims it as their own. I thought it was no biggie. "It will never happen to me." Well, I was wrong. It happens. And it hurts.
